Bryant Family Vineyards owners win dismissal of consultant’s compensation case

Bryant Family Vineyards has won their lawsuit in New York Federal District Court (Southern District of New York) to dismiss  the compensation claim by former consultant Lauren Ridenhour.

According to the judgment by United States District Judge Andrew L. Carter, Jr.:

“The dispute stems from Defendants’ refusal to pay Plaintiff, their former employee, for her time renegotiating a loan on their behalf in accordance with an alleged oral agreement between the parties.

“Defendants now move to dismiss Ridenhour’s Second Amended Complaint pursuant to Fed. R. Civ. P. 15 for failure to seek leave of court prior to amending her complaint, and Fed. R. Civ. P. 12(b)(6) for failure to state a claim.

“They argue that Plaintiff failed to allege facts that would support the requisite elements of breach of contract and promissory estoppel, and that both claims warrant dismissal under the New York Statute of Frauds. For the reasons that follow, Defendants’ motion is GRANTED.”

No word yet on whether Ridenhour plans to appeal.
